When the patient woke up, she had not consented to surgery on her left ear and wanted her right ear repaired where her pain was, so she filed a lawsuit involving lack of informed consent. The Minnesota Supreme Court ruled that although the surgery was performed correctly, the surgery was performed on the left ear without the patient`s informed consent. Therefore, the Supreme Court found that the physician had violated the patient`s rights and ruled in the patient`s favor. National studies have shown that more than 90 million Americans are unable to properly understand basic health information. There is no more critical time to understand information or have a high level of health literacy than before surgery or invasive surgery.
